1107 Emissions From Incineration of Noninfectious Waste

Regulation No. 7 1107 Emissions From Incineration of Noninfectious Waste

10/13/1989

Section 1 –

1.0 General Provisions

1.1 The provisions of Section 1 and 2 1.0 and 2.0 of this regulation shall not apply to incineration operations disposing of refuse at a rate greater than 3,000 pounds per hour. Control for such operations will be specified individually by the Department.

1.2 The provisions of this regulation shall not apply to open-pit incinerators. Control for such operations will be specified on an individual basis by the Department.

1.3 The provisions of this regulation shall not apply to incinerators which are used exclusively for experimentation. Control of such units will be specified on an individual basis by the Department.

1.4 The allowable mass emission rate for a charging rate between any two consecutive charging rates shall be determined by linear interpolation from Table 1 2-1 of this regulation.

1.5 The allowable mass emission rate for a charging rate below the minimum charging rate shall be determined by linear extrapolation from Table 1 2-1 of this regulation.

1.6 The provisions of this regulation shall not apply to the start-up and shutdown of equipment which operates continuously or in an extended steady state when emissions from such equipment during start-up and shutdown are governed by an operation permit issued pursuant to the provisions of Section 2, Regulation No. 2 2.0 of 7 DE Admin. Code 1102.

Section 2 –

2.0 Restrictions

2.1 No person shall cause or allow particulate emissions from refuse incinerators into the atmosphere in excess of the appropriate mass emission rate indicated in Table 1 2-1 of this regulation.

2.2 No person shall cause or allow the construction of any new incinerator or the reconstruction of any existing incinerator except for the disposal of:

2.2.1 a. Human remains by cremation;

2.2.2 b. Remains of animals not regulated by Regulation 29 7 DE Admin. Code 1129;

2.2.3 c. Industrial waste or sludge in specific instances where no other method of disposal is acceptable to the Secretary;

2.2.4 d. Composted refuses or sludge from sewage treatment plants specifically prepared for incineration;

2.2.5 e. Refuse regulated by the U.S. Department of Agriculture.

2.3 No person shall cause or allow the operation of an incinerator used for the destruction or disposal of wastes allowed in Section 2.2 of this regulation unless the combustion temperature in the secondary chamber is greater than 1400oF. An indicating pyrometer or other temperature control device shall be installed in such a manner to accurately determine combustion chamber temperature.
